Special Marriage Act 1954: Process, Documents and Rules Explained
The Special Marriage Act, 1954 lets any two people in India marry without religious rituals. Neither partner has to change religion. It is the law behind most interfaith and civil marriages, often called court marriages.
Many couples learn about this Act only when families disagree. Others find it when they want a simple ceremony. This guide explains who can use it and the 30-day notice. It also lists the documents and each step in clear language.

What Is the Special Marriage Act?
The Special Marriage Act is a civil marriage law. It applies to all Indian citizens, whatever their religion or caste. It also covers Indian citizens living abroad.
Couples marry before a government officer called the Marriage Officer, usually at the sub-registrar's office. You do not need a priest, pheras or a religious ceremony. Both partners keep their own religion after marriage.
People often confuse it with "court marriage." In everyday use, they mean the same thing. Our guide on court marriage in India explains how people use both terms.
Who Can Marry Under the Special Marriage Act?
Section 4 sets the conditions for a valid marriage under the Act.
| Condition | Requirement |
|---|---|
| Marital status | Neither partner can have a living spouse |
| Mental capacity | Both must be able to give valid consent |
| Age | Groom at least 21, bride at least 18 |
| Relationship | Partners must not fall within prohibited degrees of relationship |
Two Hindus can also marry under this Act if they want a civil marriage. Its use goes beyond interfaith couples.
Documents Required Under the Special Marriage Act
Requirements vary slightly by state, but most offices ask for:
| Document | Details |
|---|---|
| Notice of intended marriage | Signed by both partners, in the prescribed form |
| Age proof | Birth certificate, Class 10 certificate or passport |
| Address proof | Aadhaar, voter ID, passport or rent agreement |
| Photographs | Passport-size photos of both partners |
| Affidavit | Stating date of birth, marital status and that you are not related within prohibited degrees |
| Divorce decree or death certificate | If either partner was married before |
| Witness documents | ID and address proof of three witnesses |
Carry originals and self-attested copies. Check your local sub-registrar's website for the exact list and fees.
Special Marriage Act Process: Step by Step
- Give notice. Both partners submit a written notice to the Marriage Officer. One of you must have lived in that district for at least 30 days.
- The office publishes the notice. The Marriage Officer records it in the Marriage Notice Book and displays it at the office.
- Wait 30 days. Anyone can raise an objection during this period, but only on legal grounds listed in Section 4.
- The officer checks objections. If someone objects, the Marriage Officer inquires and decides within 30 days.
- Sign the declaration. If there is no valid objection, both partners and three witnesses sign a declaration before the Marriage Officer.
- Solemnise the marriage. The couple marries at the office, or at another place nearby, in any form they choose.
- Collect the certificate. The Marriage Officer enters the details in the Marriage Certificate Book and issues a certificate.
The marriage must take place within three months of the notice. After that, you need to give a fresh notice.
The 30-Day Notice and Privacy Concerns
The 30-day public notice is the part couples worry about most. It is meant to allow genuine legal objections, such as a partner who is already married.
But many couples fear that families or others may misuse it. In 2021, the Allahabad High Court ruled on this issue. It said that in Uttar Pradesh, publishing the notice should be optional. Rules can differ in other states, so ask your Marriage Officer about the current practice.
Several states now accept notice online through their registration portals. This saves a visit but does not remove the 30-day waiting period.
Registering an Existing Marriage Under Section 15
Couples who already married through religious rites can also register under Section 15 of the Act. This is useful for couples who want the civil protection of the Special Marriage Act. You do not need a fresh ceremony, but conditions and a notice period still apply.
Effects of Marrying Under the Special Marriage Act
The Indian Succession Act, 1925 mostly governs succession for couples married under this Act. This can differ from the rules of their personal law.
There is one exception. If both partners are Hindus, Buddhists, Sikhs or Jains, Section 21A applies. Their succession continues under Hindu law, and the marriage does not cause severance from the joint family.
Divorce Under the Special Marriage Act
Section 27 lists the grounds for divorce. These include adultery, cruelty, desertion for at least two years, serious mental disorder and a few others.
Section 28 allows divorce by mutual consent. The couple must have lived separately for one year and must jointly agree that they cannot live together. Normally, a spouse cannot file for divorce within one year of marriage.

Does the Special Marriage Act Allow Same-Sex Marriage?
No. In October 2023, the Supreme Court declined to read same-sex marriage into the Special Marriage Act. It said Parliament, not the courts, must decide on such a change.
Common Mistakes Couples Make
Many couples go to the wrong office. You must file in the district where one of you has lived for 30 days. Check this first.
Some couples bring the wrong witnesses. You need three adults with valid ID. They must come in person on the day.
Others miss the three-month limit. Once the 30 days pass, plan the date soon. If you wait too long, you must start again.
Last, keep copies of every page. Make a few certified copies of the final certificate too. You will need them for visas and bank work.
Choosing a Partner When Families See Things Differently
Many couples who use the Special Marriage Act come from different faiths, castes or regions. These marriages work best with early, open talks. Discuss religion, food, festivals and how you will raise children.
Clear conversations matter even more when families need time to come around. If you need help with that step, read our guide on how to convince parents for love marriage.
